Terms and Conditions

These Terms and Conditions ("Terms") govern all services provided by Swify.io, a hosting provider registered in Portugal, offering dedicated server solutions with datacenters located in the Netherlands, Switzerland, and Bulgaria.
By purchasing, accessing, or using any Swify.io service, the customer ("Client", "You") agrees to be bound by these Terms.




1. Definitions

Swify.io – The service provider (“Provider”, "We").

Client – Any individual or entity purchasing or using Swify.io services.

Services – Dedicated server hosting and related solutions.

Agreement – The binding contract formed between Swify.io and the Client.


2. Acceptance of Terms

By using Swify.io services, the Client confirms that they have read, understood, and agreed to these Terms.
If you do not agree, you must not use the Services.


3. Services Provided

Swify.io provides:

- Dedicated server hosting

- Network access and connectivity

- Basic infrastructure support

Swify.io does not include software configuration, development, or data management unless otherwise agreed.


4. Client Responsibilities

The Client is responsible for:

- Maintaining security and configuration of their dedicated server

- Any content hosted on or transmitted through their server

- Compliance with local and international laws

- Ensuring backups of all data hosted

Swify.io is not responsible for data loss, corruption, or unauthorized access caused by client mismanagement.


5. Acceptable Use Policy (AUP)

Clients must not use Swify.io services for:

- Hosting or distributing illegal content

- DDoS, hacking, or malicious activities

- Spam, email abuse, or unsolicited communications

- Copyright infringement

- Fraudulent, deceptive, or harmful activities

Violating the AUP may result in immediate service suspension or termination.


6. Service Availability

Swify.io aims to provide high uptime and stable connectivity but does not guarantee 100% uptime.
Swify.io is not liable for downtime caused by:

- Network issues outside our control

- Scheduled maintenance

- Hardware failures

- Force majeure events


7. Billing and Payments

- All services must be paid in advance unless otherwise agreed.

- Invoices must be paid by the due date.

- Failure to pay may result in suspension or termination of services.

- Payments are non-refundable, except where required by law.


8. Refund Policy

Swify.io does not provide refunds for:

- Partial service periods

- Interruptions or downtime outside Swify.io control

- Misconfiguration or misuse by the Client

Refunds may be granted only in exceptional cases at Swify.io's discretion.


9. Support

Support is provided for:

- Hardware issues

- Network availability

- Basic system accessibility

Support does not include:

- Software configuration

- Malware removal

- Data recovery


10. Data Protection and GDPR

Swify.io complies with the EU General Data Protection Regulation (GDPR). Processing of personal data is governed by the Data Processing Agreement (DPA), which forms part of this contract.
Swify.io does not access or monitor data stored on client servers unless required by law or explicitly requested by the Client.


11. Liability Limitation

To the maximum extent permitted by law:

- Swify.io is not liable for indirect, incidental, or consequential damages.

- Total liability shall not exceed the amount paid by the Client for the previous 30 days of service.


12. Suspension and Termination

Swify.io may suspend or terminate services if:

- The Client violates the AUP

- Payments are overdue

- Illegal or harmful activity is detected

The Client may terminate services anytime via the customer portal.


13. Server Cancellation and Data Deletion

Upon cancellation:

- All data on the server will be deleted permanently

- Swify.io does not guarantee data recovery

It is the Client’s responsibility to perform backups before cancellation.


14. Changes to Terms

Swify.io may modify these Terms at any time.
Continued use of the Services after updates implies acceptance of the new Terms.


15. Governing Law

These Terms are governed by the laws of Portugal.
Any disputes will be handled by Portuguese courts.
